Negotiating power and experience. Real Estate transactions are negotiations from start to finish. Having an Agent on your side that will be objective and armed with current market data can make the difference in how much you pay for your home. We are active participants in the markets we represent on a daily basis. This means that we have a pulse on the Real Estate Market and are ready to put that knowledge to work for you.
Objective advice is essential for a successful transaction. Purchasing your home can be an emotional experience. Westerra Agents will help you avoid the pit-falls of emotionally driven decisions, and support you with objective advice and opinions. Getting the terms of your deal right the first time is mandatory! Westerra Agents are well-versed in the process and meaning of Real Estate contracts and strive to ensure our clients are as well. Our clients know and expect that they can ask questions and will receive honest answers about the contracts they are signing. Real Estate contracts are binding, legal documents that require careful consideration and complete understanding prior to signing.
Real Estate Brokerage Relationships
In Idaho, Real Estate brokers and their sales associates are required to disclose the type of working relationship they with the buyers in a real estate transaction. As a buyer, you should know that there are several types of relationships that are available to you. You should understand these at the time a broker provides specific assistance to you in buying real estate. Buyer’s agent and Seller’s agent relationships are referred to as “agency” relationships and carry with them legal duties and responsibilities for the broker as well as for the buyer and seller.
- Buyer’s Agent:
A Buyer’s Agent acts solely on behalf of the buyer and owes duties to the buyer which includes: good faith, loyalty, and fidelity. The agent will negotiate on behalf of, and act as an advocate for; the buyer. Equally, the buyer is legally responsible for the actions of the agent when that agent is acting within the scope of agency. A separate written buyer’s agreement is required which sets forth the duties and obligations of the parties.
- Seller’s Agent:
A Seller’s Agent acts solely on behalf of the seller and owes duties to the seller which includes: good faith, loyalty, and fidelity. The agent will negotiate on behalf of, and act as an advocate for; the seller. Equally, the seller is legally responsible for the actions of the agent when that agent is acting within the scope of the agency. A separate written listing agreement is required which sets forth the duties and obligations of the parties.
